The Attorney General and Commissioner of Justice, Rivers State, Emmanuel Aguma, has debunked media reports that a Port Harcourt High Court presided over by Justice Adolphus Enebeli, has ordered the arrest of the Chairman of the Peoples Democratic Party, PDP, Felix Obuah, for allegedly sponsoring Don Wanney and other cult groups in Ogba/Egbema/Ndoni Local Government Area.
He said recent media report, is a misrepresentation of the decision of the court, ‘The issue that the court ordered that he be arrested or that he appear in any trial is absolutely false.
‘The records of the court are there for anybody to apply for and obtain. No such order was made. So I find it difficult to comprehend if it is this case they are taking about, that any such order was made by Hon. Justice Enebeli.
‘Maybe there is another case, but this case which I am privy to, which the Rivers State Ministry of Justice filed for Bro. Felix Obuah, in his capacity as the sole administrator of Rivers State Waste Management Agency, no order was made directing that he appear before any court to answer to any charge. Mr. Obuah brought the case and it was struck out.
‘As Attorney General of Rivers State, I am not aware that there are any charges pending in any high Court in Rivers State against Mr. Felix Obuah, pertaining to the issue of Don wanney.
‘I am also not aware of any charges pending against Mr. Felix Obuah concerning any other criminal matter. I am not aware. None has passed through my office and none has passed through my department of public prosecution .
‘All I know about is the fundamental human rights case that Felix Obuah brought in his capacity as the sole administrator of Rivers State Waste Management Agency, in which the court found as a fact that the police acted in bad faith and which the court struck out simply because there are so many decisions of the Supreme Court, saying you cannot restrain the police from doing its work’.
He further stated that Obuah had the right to institute fresh action if there is any violation of his fundamental human rights.
