Under the OMNIBUS PROVISIONS of the Constitution of the All Progressives Congress (APC) October 2014 (as Amended) at Article 31, the law is as follows:
1. Provided always that in pursuit of all the provisions herein contained in this Constitution, the following shall ensure that:
i. No person shall be eligible to contest for any Party position, or be nominated by the Party to be its candidate at any election, if the person is not a member of the Party.
ii. All nominations into elective offices shall be supported by a specified number of nominators from the relevant Constituencies as may be prescribed or provided for in the Party’s Electoral Guidelines.
iii. Any Party office holder interested in contesting for an elective office (whether party office or office in a general election) shall resign and leave office 30 days prior to the date of nomination or Party primary for the Office he or she is seeking to contest.
2. WAIVER
Subject to the approval of the National Executive Committee, the National Working Committee may in special circumstances grant a waiver to a person not otherwise qualified under Article 31(1) of this Constitution if, in its opinion, such a waiver is in the best interest of the Party.
3. CONDITIONS FOR WAIVER
A person may be granted a waiver only on condition that
i. He or she has not been convicted by any court of competent jurisdiction for any criminal offence.
ii. He or she has applied for waiver in writing to the National Working Committee of the Party through his/her appropriate Ward, Local Government Area/Area Council, State, Federal Capital Territory and Zonal Committee.
iii. He or she has signed an undertaking to uphold and implement the manifesto of the Party in the event of winning the election.

The above refers. I have belaboured myself to bring these things to the fore due to the calls I have been inundated with by your august listeners hours after the show wrapped up demanding that I come clear on these facts which I was unwilling to speak on in deference to the tradition to refrain from making comments on subjects submitted to the courts for adjudication.

Behold the offence that Victor Tombari Giadom committed for being the only ranking party official available at the time Edo APC began her rumble in the jungle from Ward 10 in Etsako LGA to the decision of the High Court of the Federal Capital Territory against our National Chairman, His Excellency, Comrade Adams Aliyu Oshiomhole.
NOTE Gentlemen and Lady that prior to reverting to his office as Deputy National Secretary after the judicial ambush by sons of perdition stopped his legitimate quest, Victor Tombari Giadom fulfilled all the requirements of the law as can be gleaned from the Article laid out above and from the letters in the picture evidence attached hereto.
Recall and NOTE FURTHERMORE Lady and Gentlemen, that this same Bera, Gokana-born Victor Tombari Giadom was DULY ELECTED as Deputy National Secretary at the Party’s last national convention in 2018.
NOTE FINALLY that the APC Constitution on the provision for INTERPRETATION of same states at Article 32 thereof thus:
“The Board of Trustees shall be the final authority as to the interpretation of any aspect of this Constitution and its Ruling shall be final.”
Go therefore to the mountains and over the Vale and tell it to the judiciary contractors in the Rivers APC that there is a thing civilization brings to mankind. Tell those who are now latching on the fringe triumph of Hon. Igochukwu Aguma on June 9, 2020 before the soon retiring Justice George Omereji of the High Court of Rivers State to forum shop in the Judiciary in order that Victor Tombari Giadom may be brought down that they have embarrassed us well enough with their baseless rebellion. Please tell those with an incurable inclination to impunity and anarchy that Rivers people are tired of recklessness and annoying abuse of court processes by some quarters of the APC. Let those who suddenly woke up from their slumber to realise that Victor Tombari Giadom once resigned to run for elections after the Court of Appeal in a unanimous decision this outgoing week breath life into the Order granted by the High Court of the FCT ousting Oshiomhole know that the Train left the station of their malice after thought long ago.
