A Magistrate Court in Port Harcourt, Rivers State has rejected an application by the Inspector General of Police, Solomon Arase seeking to withdraw murder charges against the former Chairman of Asari Toru Local Government Area, Hon. Ojukaye Flag Amachree.
The application which requested the release of Hon. Amachree from prison custody, to enable the police embark on thorough investigation into the alleged murder was declined.
In his ruling, the Chief Magistrate Israel Agbesor said the court lacked the power to make an order to withdraw the murder charges and release the accused from prison custody.
Agbesor struck out the matter and ordered that Hon. Amachree remain in prison custody based on the legal advice of the Director of Public Prosecution (DPP), that there was a clear case of murder established against the accused person and further directed that he should face his trial at the state High
Court.
