A Federal High Court in Port Harcourt the Rivers State capital, has thrown out an application filed by Chima Nnokam, the erstwhile candidate of the All Progressives Congress, APC, during 2015 for the Port Harcourt constituency 3 seat in the State House of Assembly, seeking to stop the by-election slated to hold August 18, 2.018.
Nnokam had gone to court to stop the conduct of the by-election scheduled to hold on Saturday to fill Port Harcourt constituency 3 seat which became vacant as a result of the resignation of Victor Ihunwo, who contested and won the chairmanship ticket to become the Mayor of Port Harcourt city Council.
Recall that Nnokam, had dragged the Independent National Electoral Commission, INEC, before a Federal High Court in Port Harcourt over the vacant Port Harcourt constituency 3 seat.
The application dated 31st July, 2018, with suit no FHC/PH/CS/85/2018, was praying the court to issue an order directing INEC to issue the certificate of return to him, having failed to conduct the by-election more than 30 days after Ihunwo vacated the seat.
Arguing that he had garnered the second highest votes in 2015.
